Terms

The MAGHELP website located at https://maghelp.net/ is a copyrighted work belonging to MAGHELP. Certain features of the Site may be subject to additional guidelines, terms, or rules, which will be posted on the Site in connection with such features.

All such additional terms, guidelines, and rules are incorporated by reference into these Terms.

These Terms of Use describe the legally binding terms and conditions that govern your use of the Site. BY LOGGING INTO OR USING THE SITE, YOU AGREE TO BE BOUND BY THESE TERMS, and you represent that you have the authority and capacity to enter into these Terms. YOU MUST BE AT LEAST 18 YEARS OF AGE TO ACCESS OR USE THE SITE.
IF YOU DO NOT AGREE WITH ALL OF THE PROVISIONS OF THESE TERMS, DO NOT ACCESS OR USE THE SITE.

These Terms require the use of arbitration on an individual basis to resolve disputes and limit the remedies available to you in the event of a dispute.


Access to the Site

Subject to these Terms

MAGHELP grants you a non-transferable, non-exclusive, revocable, limited license to access and use the Site solely for your personal and non-commercial use, unless otherwise expressly permitted by MAGHELP.

Certain Restrictions

The rights granted to you under these Terms are subject to the following restrictions:

(a) you shall not sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit the Site, except as expressly permitted by MAGHELP;
(b) you shall not modify, create derivative works of, disassemble, reverse compile, or reverse engineer any part of the Site;
(c) you shall not access the Site to build a similar or competitive website or service;
(d) except as expressly stated herein, no part of the Site may be copied, reproduced, distributed, republished, downloaded, displayed, posted, or transmitted in any form or by any means.

Any future release, update, or addition to the functionality of the Site shall be subject to these Terms. All copyright and proprietary notices must be retained on all copies.

MAGHELP reserves the right to modify, suspend, or discontinue the Site, or any part thereof, at any time with or without notice. You agree that MAGHELP shall not be liable to you or any third party for any modification, suspension, or termination of the Site.

No Support or Maintenance

You agree that MAGHELP has no obligation to provide support or maintenance in connection with the Site.

All intellectual property rights in the Site and its content, excluding User Content, are owned by MAGHELP or its licensors. These Terms do not grant you any ownership rights in such intellectual property.


User Content

User Content

“User Content” means any content, data, information, or material submitted, uploaded, published, or displayed by a user on the Site.

You are solely responsible for your User Content and all risks associated with it. You represent and warrant that your User Content complies with these Terms and the Acceptable Use Policy.

MAGHELP does not guarantee the backup or preservation of User Content and may remove User Content at any time without notice.

You grant MAGHELP a perpetual, irrevocable, non-exclusive, royalty-free, worldwide license to use, reproduce, distribute, publicly display, perform, modify, and create derivative works of your User Content solely for operating, promoting, and improving the Site. You waive any moral rights related to your User Content.


Acceptable Use Policy

You agree not to use the Site to upload, transmit, or distribute User Content that:

(i) violates any intellectual property or proprietary rights;
(ii) is unlawful, abusive, harassing, defamatory, misleading, obscene, or otherwise objectionable;
(iii) promotes discrimination, hatred, or harm against individuals or groups;
(iv) is harmful to minors;
(v) violates any applicable law or regulation.

You also agree not to:

(i) distribute malware or harmful software;
(ii) send spam or unsolicited promotional messages;
(iii) collect or harvest data from other users without consent;
(iv) interfere with Site security or operation;
(v) attempt unauthorized access to the Site;
(vi) use automated scripts or bots to create accounts or interact with the Site.

MAGHELP reserves the right to review, remove, or restrict User Content and accounts that violate these Terms or create legal risk.


Feedback

Any feedback or suggestions you provide to MAGHELP are non-confidential and may be freely used by MAGHELP without compensation.


Indemnification

You agree to indemnify and hold harmless MAGHELP, its officers, employees, and agents from any claims, damages, or expenses arising out of your use of the Site, violation of these Terms, or User Content.


Third-Party Links & Other Users

The Site may contain links to third-party services. MAGHELP is not responsible for third-party content or services.

MAGHELP is not responsible for interactions between users. Any disputes between users are the sole responsibility of the parties involved.


Cookies and Advertising

MAGHELP uses cookies and similar technologies to improve user experience. Third-party advertising partners may also use cookies in accordance with their own privacy policies.


Disclaimers

The Site is provided on an “AS IS” and “AS AVAILABLE” basis. MAGHELP disclaims all warranties, express or implied, including fitness for a particular purpose and non-infringement.


Limitation of Liability

To the maximum extent permitted by law, MAGHELP shall not be liable for indirect, incidental, or consequential damages. Total liability shall not exceed USD $50.


Term and Termination

These Terms remain in effect while you use the Site. MAGHELP may suspend or terminate access at any time for any reason. Upon termination, your access and User Content may be removed.


Copyright Policy

MAGHELP respects intellectual property rights and complies with applicable copyright laws, including the DMCA. Notices of infringement must comply with 17 U.S.C. § 512(c).


Dispute Resolution & Arbitration

All disputes shall be resolved through binding arbitration on an individual basis, in accordance with the rules of the American Arbitration Association (AAA), unless otherwise prohibited by law.


Governing Law & Jurisdiction

Where arbitration is not applicable, disputes shall be subject to the jurisdiction of courts located in California, United States.


Electronic Communications

You consent to receive communications from MAGHELP electronically and agree that such communications satisfy legal requirements.


Entire Agreement

These Terms constitute the entire agreement between you and MAGHELP regarding the Site.
